“Counselor,” Judge Garcia began, her voice echoing in the courtroom. “Your client is requesting unsupervised visitation of two seven-week-old infants, despite an active police investigation into reckless endangerment involving his mother.”
Derek’s attorney stood up, straightening his jacket. “Your Honor, my client, Derek Vance, is a loving, gainfully employed father who was entirely unaware of any medical danger. His mother acted independently out of genuine concern for the infants’ nutritional needs. Mrs. Vance is suffering from severe postpartum anxiety and is weaponizing the court system to alienate my client from his children.”
My lawyer, Brenda, immediately stood up.
“Your Honor,” Brenda said calmly. “We have submitted into evidence the police incident report, the pediatric ER discharge papers, and a sworn affidavit from Dr. Bennett confirming that the child experienced an acute allergic reaction due to deliberate exposure to a known allergen.”
Brenda placed a thumb drive on the podium.
“Furthermore, we have submitted audio evidence from the night of the incident,” Brenda continued.
Derek’s eyes went wide with panic. He looked back at his mother, who suddenly sat up straight in her chair.
“Audio evidence?” Judge Garcia asked. “Explain, Ms. Vance.”
“Our home is equipped with a motion-activated nursery camera system that records audio in the living room area,” Brenda explained. “The recording from 3:45 AM clearly captures Mr. Vance and his mother, Donna Vance, discussing the plan.”
Brenda clicked a button on her laptop, and the audio echoed through the courtroom speakers.
Donna’s Voice: “Just let her sleep, Derek. Once I feed Molly this bottle and she doesn’t drop dead, Megan will have to admit she’s been dramatic. We can finally get these babies on a proper schedule.”
Derek’s Voice: “Mom… what if Megan wakes up and sees the milk is gone?”
Donna’s Voice: “I’ll tell her it was spoiled. She won’t know the difference. Do you want to sleep through the night or not?”
Derek’s Voice: “Okay. Just make sure she finishes it before Megan comes down.”
The courtroom went dead silent.
